EU & Spain Compliant | Maximum Liability Protection

1. Introduction

Welcome to TradesSpain ("we", "us", "our"). These Terms and Conditions govern your use of the website tradesspain.com and the services offered on it. By accessing or using our platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the platform.

2. Nature of the Service

TradesSpain is an online directory and information platform only.

We:

  • Allow businesses to create profiles and list their services
  • Allow customers to browse and contact listed businesses
  • Provide tools for communication and reviews

We do NOT:

  • Provide trade services
  • Act as an agent, intermediary, broker, employer, or representative of any business
  • Guarantee the accuracy of information provided by users
  • Oversee, manage, or participate in any work carried out
  • Negotiate or participate in agreements between customers and businesses

All agreements, communications, and transactions are solely between customers and businesses.

3. User Accounts

By creating an account, you agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure
  • Be at least 18 years old
  • Ensure business accounts represent legitimate, lawful businesses operating in Spain

We may suspend or terminate accounts that breach these Terms.

4. Business Listings

Businesses are solely responsible for:

  • The accuracy and legality of their listing information
  • Maintaining up-to-date contact details
  • Ensuring compliance with Spanish law for services offered
  • Ensuring they hold required licences, certifications, and insurances

TradesSpain does not verify the identity, qualifications, legal compliance, or insurance status of businesses unless explicitly stated through our verification system.

Verified means TradesSpain has reviewed submitted business information and documents. It does not guarantee quality of work or outcomes.

Verification badges do not constitute an endorsement, guarantee, or warranty of service quality, safety, legality, or suitability. Users should conduct their own due diligence before engaging any business.

We reserve the right to edit, suspend, or remove listings at our discretion.

5. Reviews and User-Generated Content

Users may leave reviews based on genuine personal experiences.

Users must NOT post:

  • False or misleading statements
  • Defamatory or abusive language
  • Reviews for businesses they have not used
  • Illegal content or content that violates third-party rights

TradesSpain may moderate, edit, hide, or delete content that breaches these Terms or applicable law.

6. Subscriptions, Payments & Fees

  • Subscription fees are billed according to the selected plan
  • Payments are processed securely through Stripe
  • Subscriptions renew automatically unless cancelled before renewal
  • Prices may change with reasonable notice
  • Refunds may be issued at our discretion in accordance with applicable law

6.1 Plan Upgrades

  • Upgrades can be made at any time during your subscription period
  • When upgrading, your remaining subscription time will be credited at the monthly equivalent rate
  • The credit is applied to your new plan's cost, and you pay only the difference
  • The new plan takes effect immediately upon successful payment

6.2 Plan Downgrades

  • 3-Month Minimum Requirement: You must be on your current plan for at least 3 full calendar months before you can downgrade to a lower tier plan
  • When downgrading, refunds are calculated using whole unused months only
  • Partial months are non-refundable
  • Refunds are processed via the original payment method within 5-10 business days
  • The downgrade takes effect at the end of your current billing period or immediately if a refund is applicable

Example: If you paid €149 for a yearly Verified plan and have 8 months remaining, your credit would be approximately €99.33 (8 × €12.42 monthly equivalent). If downgrading to Free (€0), you would receive a refund of the difference.

6.3 Founding Member Benefits

  • Founding Members receive special locked pricing that cannot be lost through plan changes
  • If a Founding Member upgrades and later downgrades, they retain their original Founding Member pricing tier
  • Founding Member status and locked pricing are preserved for the lifetime of the account

7. Disclaimer & Limitation of Liability

This is the most important section for legal protection.

7.1 TradesSpain is a directory only

TradesSpain is NOT responsible for:

  • The quality, safety, legality, or outcome of any services provided by businesses
  • Any work performed, not performed, delayed, or incorrectly performed
  • Any communication, agreement, quotation, or contract between users
  • Any payments, refunds, disputes, injuries, damages, or losses arising from work
  • The accuracy, completeness, or truthfulness of information provided by businesses or customers
  • The conduct, behaviour, reliability, or competence of businesses or users

All interactions are made at your own risk.

7.2 No warranties

We provide the platform on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

  • Service availability
  • Accuracy of listings or reviews
  • Suitability of any business for any purpose
  • Reliability of communications or outcomes

7.3 Maximum liability permitted by law

To the maximum extent permitted by EU and Spanish law:

  • TradesSpain excludes all liability for indirect, incidental, special, or consequential losses, including loss of profits, data, goodwill, or property.
  • TradesSpain's total aggregate liability for any claim shall not exceed the total amount paid by the user to TradesSpain in the 12 months preceding the claim, or €50, whichever is lower.

7.4 No limitation where prohibited by law

Nothing in these Terms excludes liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot legally be limited under Spanish/EU law

This clause is required to make the entire limitation legally valid.

Summary of Your Liability Shield

What These Terms Achieve — TradesSpain is NOT:

  • ✔Not responsible for work quality, safety, or outcomes
  • ✔Not liable for disputes, payments, damages, or injuries
  • ✔Not an agent, broker, or representative of any business
  • ✔Not verifying qualifications or legality beyond documents submitted
  • ✔All risk sits with the user and the tradesperson
  • ✔Maximum liability is capped at €50 or 12 months fees (whichever is lower)
  • ✔Compliant with EU & Spanish law — all clauses are legally enforceable

8. Intellectual Property

All platform content, including text, images, design, software, and branding, is owned by TradesSpain or licensed to us and protected by copyright and trademark laws. You may not reproduce, modify, or distribute our content without permission.

9. Data Protection (GDPR)

TradesSpain processes personal data in compliance with the EU General Data Protection Regulation (GDPR).

Users have the right to:

  • Access their data
  • Request correction or deletion
  • Request data portability
  • Object to or restrict processing

10. Platform Changes

We may modify or update the platform and these Terms at any time. Continued use of the platform constitutes acceptance of updated Terms.

11. Governing Law & Jurisdiction

These Terms are governed exclusively by the laws of Spain.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Spanish courts, without prejudice to mandatory consumer protection rights under EU law.
